Council Heritage Permit Application Decision Appealed to OLT

A quick update, neighbour, on the progress of our Friends of Olde Berlin Town campaign in pursuit of a compatible, inclusive development of 22 Weber St W that permits existing neighbours to thrive and the Heritage District to endure.

On August 22, 2022, Council unanimously refused the developer’s Heritage Permit Application in support of their proposed development at 22 Weber St W.  And, as expected, the developer immediately appealed Council’s decision to the Ontario Land Tribunal. The Tribunal will hold a Case Management Conference (CMC) on the Heritage Permit appeal concurrent with the fifth CMC on the Official Plan Amendment and Zoning Bylaw appeals at 10am, Wednesday, October 26, 2022.  The CMC will identify any additional parties, participants, issues, and more. The Tribunal’s notice of the CMC with details on how to attend the video conference is available here.  The developer’s Notice of Appeal is available here.

Anyone wishing to have their voice heard by the Tribunal — the final decision-making body — may submit a Participant status request form by October 14, 2022 (at least 10 days in advance of the CMC).  One need not submit one’s full statement to the Tribunal at this time.  Details available here.  Another option, of course, is to support Friends of Olde Berlin Town, a Party at the Tribunal.

Please:

  1. Seek participant status, if you wish.  Details here.
  2. Contribute to our campaign.  We need funds to secure legal assistance and have our expert witnesses testify at the hearing.  Every contribution counts, regardless of size.  Kindly visit our website for details.
