FOBT Submits Request for Review of OLT Decision

As you know, on September 17, 2025, the Ontario Land Tribunal released its decision. The Tribunal approved both the developer’s Official Plan Amendment and Zoning By-law Amendment applications.
 
The Parties, including FOBT and the City, then had 30 days in which to file a “Request for Review” of the decision via the Chair of the Tribunal or an appeal via the courts, should they have wished to do so.  FOBT elected to submit a Request for Review, which you can read here.
 
A Request for Review can only be filed on particular grounds (inadequacies in procedure, errors of fact, etc.).  A decision on our Request for Review is expected in about a month.  The Tribunal may:

  • dismiss our request,
  • rescind the decision,
  • order a re-hearing,
  • vary any orders or decisions of the Tribunal or
  • dismiss the appeals (and reject the Applications).

The City did not file a Request for Review.  Many municipalities do not typically seek a review of or appeal Tribunal decisions.
 
We intend to share a fulsome commentary on the decision and our Request for Review after the Tribunal’s decision-making process is finalized.
 
We recognize that the zoning of the portion of Weber St W inside the Heritage District has been before our community since 2008 and that the disagreement over the development applications at 22 Weber St W has been under public review since August 2020.  Much has changed in the interim.  In March 2024, new land-use designations and zoning were put into place for lands along Weber St W, inside the Heritage District and throughout Olde Berlin Town, the downtown, and seven Major Transit Station Areas (areas around ION stops).  And, at the same time, many new challenges have emerged in our city, province, country, and around the world.
