On September 17, 2025, the Ontario Land Tribunal released its decision. The Tribunal has approved both the developer’s Official Plan Amendment and Zoning By-law Amendment applications. The Tribunal concluded that the proposal has regard for matters of provincial interest, is consistent with provincial policies, conforms to the Region’s Official Plan and the City’s Official Plan and the Heritage District Plan, represents good planning and is in the public interest.1

Friends of Olde Berlin Town (FOBT), alongside the City of Kitchener, had argued that the development was inappropriate due to its lack of transition to the surrounding neighbourhood and negative impact on the Civic Centre Heritage District.
We are reviewing the Tribunal’s decision and considering possible next steps.

It is consistent with the PPS 2024 and conforms to the City OP and Region OP, both of which promote intensification in underutilized sites within the Built-Up Urban Area. The Revised Proposal has sufficient regard for the UDM, is consistent with the objectives of the District Plan, represents good planning, and is in the public interest.” ↩︎
